In Las Vegas, it is a crime to drive a vehicle under the influence of drugs or alcohol. Your BAC level should not be more than .08%. This limit is .04% for commercial drivers, and for those under 21 years of age, it is .02%.

The first offense of DUI is a misdemeanor, and typical penalties include 2 days to 6 months of imprisonment, $400-$1000 of fines, driving license suspension for 185 days, attendance at Victim Impact Panel, and online DUI School. Subsequent DUIs and DUIs that caused substantial harm to someone or something carry harsher penalties.

If you have been charged with DUI charges in Las Vegas, you must hire a Las Vegas DUI lawyer who can settle your case with easier penalties.

Penalties for First DUI

First DUI is treated as a misdemeanor, for which you can get 2 days to 6 months of imprisonment and pay a penalty of $400 to $1,000. You also need to enroll in a DUI School, a program ordered by courts to spread education and alcohol prevention. You need to attend a Virtual Impact Panel, a meeting in which DUI victims share their experiences about how drunk driving affected their lives.

If your BAC (blood alcohol content) was more than 0.18%, you might be ordered to install an ignition interlock system in your vehicle for 12-36 months. Your driving license will be suspended for 185 days. You may also avoid the conviction by finishing an intensive program of rehabilitation known as Misdemeanor DUI Court.

Penalties for Second DUI

The second DUI charge in Las Vegas is also treated as a misdemeanor, but with harsher penalties. The minimum imprisonment period is extended to 10 days, and the amount of the minimum fine would be $750. You also need to attend the Virtual Impact Panel and install a breath interlock device in your vehicle for 185 days. Your license may be suspended for one year. Avoid conviction by completing a Misdemeanor.

Penalties for Third DUI

The third DUI charge comes under Category B felony, for which you have to spend time in a Nevada State jail for 1 to 6 years and pay a fine of $2,000 to $5,000. This time, you may get your license suspended for three years. Virtual Impact Panel and installation of a breath interlock device for 12-36 months are also mandatory. You have to complete the Felony DUI Court to avoid a felony conviction.

DUI that Caused Death or Injury

Treated as a Category B felony, you may be imprisoned for 2 to 20 years and pay a fine of $2,000 to $5,000. Your license will be suspended for three years, and you will have to attend the Victim Impact Panel and install a breath interlock or IID for 12-36 months. If you already had three DUI convictions, it becomes a vehicular homicide, and you may receive a life sentence under Category A felony.

DUI After Felony Conviction

Treated as a Category B felony, you get imprisonment of 2 to 15 years and pay a fine of $2,000 to $5,000. 3-years license suspension, Victim Impact Panel, and IID installation for 12-36 months are also mandatory.

So, here are the penalties for DUI in Las Vegas. Get in touch with a Las Vegas DUI lawyer immediately to minimize your charges and penalties.
